ARTICLE 1: Purpose

The purpose of these general terms of use is the legal arrangements for the terms of provision of the services of the web site https://erecruiting.reseau-def.com (hereinafter referred to as the « Site ») and the use thereof by « the User ».

The general terms of use should be accepted by any User wanting to access the site. They are the contract between the site and the User. Access to the Site by the User means his or her acceptance of these general terms of use.

ARTICLE 2: Legal information

The publishing of the site erecruiting.reseau-def.com is handled by the COFLEC SARL company, with a share capital of 30 000 412 Euros whose registered address is at: 7 rue du Saule Trapu, Parc d’Activité du Moulin de Massy – 91300 MASSY registered with the business and companies register of Evry under number 340 087 576.

The host of the site erecruiting.reseau-def.com is the ADEQUASYS SARL company whose registered address is at 1 rue Claude Bernard - 26100 ROMANS-SUR-ISERE registered in the business and companies register of Romans under number 403 107 683.

ARTICLE 3: Definitions

The purpose of this clause is to set forth the various essential terms of the contract :

• User: this term designates any person who uses the site or one of the services offered by the Site.
• User Content: this is the data passed on by the User within the Site.
• Member: the User becomes a member when he or she is identified on the Site by setting up an account.
• Username and password: this is all the information needed to identify a User on the Site. The username and password allow the User to access services reserved for members of the Site. The password is confidential.

 
ARTICLE 4: Access to services

To become a User, these Terms and Conditions must be accepted without any reservations.

The site allows the User free access to the following services:

• Viewing of job offers
• Filing of curriculum vitae on the platform
• Application for proposed offers
• Unsolicited applications
• Access to the history of a personal file
• Management of personal data

The site is accessible free of charge anywhere to any User with Internet access. All costs incurred by the User to access the service (hardware, software, Internet connection, etc.) are his or her responsibility.

A non-member User does not have access to the services. Access to services dedicated to members is done using a username and password.

By applying for a job offer or submitting an unsolicited application, the User automatically sets up an account, this procedure generates the sending of an e-mail containing a registration validation link, the User then has to choose his or her password. The User can also create an e-mail alert to receive directly on his or her e-mail address job offers likely to interest him or her according to the criteria he or she previously selected.

The password chosen as well as the e-mail address provided by the User when registering and/or setting up the e-mail alert constitute the means of identification of the member. They allow him or her to have access to his or her User account and to receive job offers.

These means of identification are confidential and the member is the only one who knows them. Thus, the member is solely responsible for any use that may be made thereof, as well as the sole guarantor of their confidentiality or of any use of his or her User account.

It is expected that the Member can change his or her password at any time, in the same way that he can update the data concerning him or her by clicking on the fields provided for this purpose.

The Site implements all the means at its disposal to ensure quality access to its services. The obligation being a duty of reasonable endeavours, the Site does not undertake to achieve this result.

No event due to a case of force majeure resulting in a malfunction of the network or the server or the Site shall lead to the responsibility of erecruiting.reseau-def.com

Access to the services of the Site may at any time be subject to interruption, suspension, modification without notice for maintenance or for any other case. The User undertakes not to claim any compensation following the interruption, suspension or modification of this contract.

ARTICLE 5: Intellectual property

The trademarks, logos, signs and any other content of the site are protected by the Intellectual Property Code and more particularly by copyright.

The User shall request the prior authorization of the Site for any reproduction, publication, copy of the various contents.

The User agrees to use the content of the Site in a strictly private context. Use of content for commercial purposes is strictly prohibited.

Any content posted by the User is his or her sole responsibility. The User agrees not to upload content that may harm the interests of third parties. Any legal action brought by an injured third party against the Site shall be borne entirely by the User.

The content of the User may be at any time and for any reason deleted or modified by the site publisher. The User shall not receive any justification and notification prior to the deletion or modification of the User’s content

ARTICLE 6: Personal data

6.1 Introduction

The information requested when registering with the Site is necessary and mandatory for the setting up of the User's account. In particular, the email address may be used by the Site for the administration, management and coordination of the service.

The Site provides the User with the collection and processing of personal information with respect for privacy in accordance with Act No. 78-17 dated January 6, 1978 relating to data processing, files and freedoms as well as the General Data Protection Regulation dated April 27, 2016.

6.2 Processing and purpose

The personal data collected on the Site are subject to computer processing.

These data will be processed automatically by the publishers of the platform when a User's personal data are entered during the first registration. Personal data is considered to be all data that can identify a User.

This data is collected and used to simplify User access to the services offered on the Site. Thus, the personal data provided is not transmitted to third parties outside the company COFLEC or its subcontractors for the purposes of hosting.

However, this data may be passed on to relevant public authorities, within the framework of the legal obligations of the controller.

Personal data will be kept for 2 years from the last contact. They may be kept, anonymously, beyond this period for statistical purposes.

6.3 Rights of the User

The processing of the User's data is based on his consent.

Under applicable regulations, the User has multiple rights (right of access, rectification, deletion and portability of your data, right of opposition and limitation of processing, right to define directives relating to the fate of your data) which he or she may exercise subject to proof of identity by indicating his name, his first name, his postal address as well as an e-mail address, all by writing to the e-mail address: rgpd@reseau- def.com or via his or her personal space, a contact form or by post.

At the end of two years without activity by the User, his or her collected data will be automatically overwritten.

ARTICLE 7: Liability and force majeure

The sources of the information circulated on the Site are deemed to be reliable. However, the Site reserves the option of not guaranteeing the reliability of the sources. The information given on the Site is for informational purposes only and without contractual value. Despite regular updates, the publisher and the Site host decline any responsibility in the event of modification of the administrative and legal provisions appearing after publication. The same applies to the use and interpretation of the information shown on the platform. Thus, the User alone assumes full responsibility for the use of the information and content of this Site.

The User makes sure to keep his or her password secret. Any disclosure of the password, in whatever form, is prohibited.

The User assumes the risks associated with the use of his or her username and password. The publisher and the host of the Site decline any responsibility for any viruses that may infect the User's computer equipment after using or accessing this site.

Any use of the service by the User resulting directly or indirectly in damages shall lead to compensation for the benefit of the publisher of the Site.

The Site provides no optimal guarantee of the security and confidentiality of the data transmitted. However, the Site agrees to implement all necessary means to better guarantee the security and confidentiality of data.

The Site cannot be held liable in the event of force majeure or the unforeseeable and insurmountable act of a third party.

ARTICLE 8: Hypertext links

Outgoing hypertext links may be present on the Site, however the web pages to which these links lead in no way incur the responsibility of erecruiting.reseau-def.com which does not have control of these links.

The User shall therefore refrain from seeking the responsibility of the site concerning the content and resources relating to these outgoing hypertext links.

ARTICLE 9: Cookies

During visits to the Site, the automatic installation of a cookie on the User's navigation software may occur.

Cookies correspond to small files temporarily stored on the hard drive of the User's computer. These cookies are necessary to ensure accessibility and navigation on the Site. These files do not contain personal information and cannot be used to identify a User.

The information contained in cookies is used to improve browsing performance on the erecruiting.reseau-def.com site.

By browsing the site, the User accepts cookies. Their deactivation can be done via the settings of the navigation software.

ARTICLE 10: Evolution of the contract

The publisher of the site reserves the right at any time to modify the clauses stipulated in this contract.

ARTICLE 11: Term

The term of this contract is open-ended. The contract takes effect with respect to the User as from the use of the service.

ARTICLE 12: Applicable law and jurisdictional clause

French law shall apply to this contract. If a dispute arisen between the parties cannot be solved amicably, only the Courts of Paris shall have jurisdiction.
